When two people live together multiple decades, or any amount of time, and have a spousal relationship, why should it be that one person must be a man and one person must be a woman in order to enjoy legal protections such as the spousal privilege? What difference does gender make in this situation? What element does a man and woman couple have that makes their lives more private, and more legally protected, than a same-sex couple? Spousal privilege, like priest-penitent privilege and doctor-patient privilege, should be based on relationship rather than gender, and the best way to legally establish that relationship is to allow homosexuals to marry to make it clear that relationship exists, and hence, to provide the same legal protections.
